CNJ removes three judges from Amazonas due to poor management and slow processes

TJAM informed that it will fully comply with the decision made by the CNJ, observing its terms and determinations, within the scope of its institutional competence. See below what the decision says about each magistrate: Leoney Figliuolo Harraquian The main problems highlighted in the magistrate's conduct are the delay in analyzing the processes and failures in the management of the processes. The judge has 18 injunctions that have been suspended for more than 30 days, and 18 cases that have been suspended for more than 120 days, which harms the functioning of the Justice Department in Amazonas. Harraquian, for example, keeps MPAM's administrative improbity actions suspended for long periods. Rosselberto Himenes The CNJ investigation found that Rosselberto Himenes' case collection increased by approximately 30% in 1 year, with 81 injunctions suspended for more than 30 days. The removal decision mentions that old cases remain without a ruling for periods of more than 15 years, generating a pattern of case conclusions without a definitive decision. One of the cases mentioned by the CNJ is related to an adverse possession process distributed in 2011, which has 31 cases awaiting decision, without any sentence on the merits having been handed down. Even so, data released by the Court in which the magistrate works indicates a situation of normality that is inconsistent with the paralyzed processes. In a statement, Rosselberto Himenes stated that he was surprised by the decision to leave him. He also informed that he will present a defense in the case brought against him and stated that the 7th Civil and Work Accidents Court, where he works, met 103.82% of the annual national targets and 126.55% of the monthly targets. Marco Antônio Pinto da Costa According to the CNJ, the judge has a collection of 15,769 cases, 3,987 of which were sent to his office and awaiting an official statement from the judge to continue the process in court. Of these, 1,869 processes have been concluded for more than 120 days. Marco Antônio also has 51 injunctions that have been suspended for more than 30 days. Furthermore, the CNJ pointed out signs of unequal treatment between the parties and a lack of impartiality in the conduct of the processes. Among the cases analyzed, there are attachment requests made by the Public Treasury that remained unfulfilled for years and the change of a sentence by another magistrate in favor of a supermarket chain, after a request for reconsideration. Judge Elci Simões de Oliveira and judge Jean Carlos Pimentel dos Santos, from the Single Court of the District of Presidente Figueiredo, were removed on February 21, 2025. Roger Luiz Paz de Almeida, from the Court of Executions of Alternative Measures and Penalties (Vemepa), was removed a week later, on February 28, 2025. All employees jurisdictions were removed on suspicion of involvement in irregularities in the conduct of a legal process involving Centrais Elétricas Brasileiras (Eletrobras). The case involved a withdrawal of R$150 million from the company.
