The case was analyzed in the Direct Action of Unconstitutionality (ADI) 7984/AM. According to the notice, the election will follow the procedure established in article 8 of the Internal Regulations of the Legislative Assembly. The call responds to a request signed by the absolute majority of state deputies and was made based on the constitutional and regulatory attributions of the Presidency of the House. Understand the case The vacancy of the Presidency of Aleam occurred after the departure of the then president of the House, Roberto Cidade (União Brasil), to take over the Government of Amazonas, after the simultaneous resignations of the then governor Wilson Lima (União Brasil) and the vice-governor, Tadeu de Souza (Progressistas). Initially, the Internal Regulations provided that the 1st vice-president would automatically assume the role until the end of the term. However, the Attorney General's Office questioned the constitutionality of this rule in the STF. When analyzing the case, Minister Flávio Dino granted an injunction suspending the device and ordered the Assembly to hold a new election to fill the position, as he understood that the definitive replacement of the president must occur through the plenary's choice. With the publication of the notice, Aleam complies with the Supreme Court's determination and will begin the process of choosing the new president in the extraordinary session scheduled for July 15th.
