TRE of Pará revokes mandates of mayor and deputy of Abaetetuba for abuse of power in 2024 campaign

The Plenary of the Regional Electoral Court of Pará (TRE of Pará) decided to revoke the mandates of the mayor of Abaetetuba, in the northeast of Pará, Francineti Carvalho (MDB), and her deputy, Edileuza Muniz (PT). The judge reporting the case, Daniel Conceição Filho, voted to condemn the candidate and was accompanied by three other magistrates. There were two differences, consolidating the score of 4 votes to 2 in favor of the revocation. Promotion in optician motivated process The complaint that led to the loss of mandates involves a promotion carried out by an optician in Abaetetuba during the campaign period. The commercial establishment offered eye exams, free frames and special discounts for customers who presented a photo next to Francineti Carvalho, who was running for re-election. According to the rapporteur's understanding, the commercial action directly compromised the principle of equal conditions between candidates competing in the municipal election. Although it determined the revocation, TRE-PA considered that the direct participation or consent of the mayor and deputy in the preparation or offering of benefits from this perspective was not proven. Even so, the majority of judges considered that the imbalance caused by the promotion in the electoral dispute was sufficient to justify the punishment. The dispute for the Mayor of Abaetetuba in 2024 was defined by a minimal margin. Francineti Carvalho was re-elected with 42,368 votes, a difference of just 32 votes in relation to the runner-up in the dispute.
