PORTO ALEGRE, RS (FOLHAPRESS) - The Rio Grande do Sul Civil Police preventively arrested a man this Thursday (20) on suspicion of the death of his 4-year-old niece in Porto Alegre.

Nicolas Gabriel Almeida Staubus, 22, confessed to the crime in a statement to investigators, according to delegate Alice Fernandes, from the 3rd Police Station for the Protection of Children and Adolescents.

To Folha de S.Paulo, the State Public Defender's Office, which defends Nicolas, said that it will "evaluate the investigative and evidentiary elements that have been collected so far and also regarding the regularity of the arrest."

On Monday (17), Nicolas and his wife took the girl to UPA Bom Jesus, in the east of the capital of Rio Grande do Sul, already dead.

At the scene, doctors noticed purple spots on the girl's body and called the police, but Nicolas fled when the agents arrived. The death certificate indicated polytrauma as the cause of death.

The medical team also identified, after examinations, suspicion of sexual violence - which, according to the delegate, Nicolas denies having committed. The police are awaiting the conclusion of the investigation to confirm the hypothesis.

Nicolas was sent to the Prison Management Center in Porto Alegre, and was awaiting a custody hearing before being sent to a prison unit.

According to the delegate, he said he spanked the girl as a form of punishment.

The victim had lived with his aunt and uncle for about two months. The aunt, sister of the girl's mother, told investigators that she noticed injuries on the child's body when she arrived home from work, which led to an argument with Nicolas.

Hours later, she found the girl sleeping in bed with foam at the mouth, which prompted her to go to the UPA. The aunt is treated as a witness in the investigation.

The mother gave a statement on Wednesday (19) and told the police that she had not seen her daughter for two months and was prevented from having contact with her.

The court authorized the extraction of data from a cell phone seized from the couple's home, which the police consider relevant to the investigation.

The Public Ministry of Rio Grande do Sul stated that it will receive the girl's family members for reception and legal guidance. The case is being carried out under judicial secrecy.
