The project advanced in the Chamber of Deputies after the Commission for the Defense of Women's Rights approved a favorable opinion from the rapporteur, deputy Fernanda Melchionna (PSOL-RS). According to the text approved by the commission, the additional would be granted for each child, whether biological or adopted. However, there is a limit of up to three children. In this way, a woman who meets the rules could accumulate increases of 5% per child, reaching a maximum increase of 15% in the amounts received by the General Social Security Regime (RGPS).
Despite approval by the commission, the benefit is not yet valid. Therefore, no insured person can currently request an increase to the INSS. The project still needs to go through other stages before eventually becoming law.
The processing takes place conclusively by the committees, which does not require a vote in the Chamber Plenary, but requires analysis by the responsible bodies. The proposal still needs to be distributed and voted on by the Social Security, Social Assistance, Childhood, Adolescence and Family Committee, the Finance and Taxation Committee and the Constitution, Justice and Citizenship Committee (CCJ).
Only if it is approved in all these phases in the Chamber of Deputies, the matter can proceed to the Federal Senate. After approval in the Senate, the sanction of the Presidency of the Republic will still be necessary for the measure to become officially valid.
Therefore, although the project represents a possibility of an increase of up to 15% for certain insured women, the additional amount is not yet included in INSS payments.
