MANUELA MOURÃOSÃO PAULO, SP (FOLHAPRESS) - The defense of actor Marco Furlan spoke out against the indictment of the actor by the São Paulo Civil Police, on suspicion of rape of a vulnerable child against a five-year-old boy. The case happened on August 2, during a party at a farm in Pindamonhangaba, in the interior of São Paulo.

In a statement, Furlan's lawyer, Graciele Queiroz, questioned the duration of the investigation, completed in five days, and stated that steps considered relevant by the defense were not carried out. "It causes concern to the defense that an investigation of such seriousness was closed in such a short period of time, without further investigation that could contribute to the full clarification of the facts", says the statement.

The defense also disputes a version attributed to the actor during the investigation. According to the lawyer, Furlan "never claimed to have confused the child with anyone else." A previous version claimed that the actor had confused the child with his girlfriend. Another version suggests that the artist was drunk and did not remember anything.

The statement also states that there were around one hundred people at the party and 22 inside the house at the time of the events and questions the lack of collection of materials and hearing from everyone present. "The defense will demonstrate, through legal means and based on the evidence, Marco Furlan's innocence", says Queiroz.

The child's lawyers claim that the investigation gathered statements from the mother, witnesses and police officers who responded to the incident, in addition to medical care, sexological examination and psychological evaluation.

In a note, they say that "the child's mother heard screams coming from the room in which the minor was sleeping and, upon checking the situation, found the person under investigation undressed in the same room where the child was also undressed. The victim was crying and complaining of pain, circumstances that were also noticed by other people present at the scene."

According to the statement, the reports showed "convergence regarding the dynamics of the facts and the circumstances immediately before and after the incident."

The lawyers also state that the physical examination did not identify macroscopic lesions, but emphasize that this result, in isolation, does not rule out the possibility of the crime being investigated. "The absence of physical injuries is not sufficient, in itself, to rule out the occurrence of the crime being investigated", says the note. Additional exams were collected and should be completed within the next 30 days.

According to the child's lawyers, the police authority's final report showed "sufficient evidence of materiality and authorship", based on the statements and other elements gathered. The statement highlights, however, that pending exams must still be awaited and that it is up to the Public Prosecutor's Office and, subsequently, the Judiciary to evaluate the set of evidence.
